2. General information
We process personal data only where necessary to provide this website, communicate with interested persons and users, or operate the Founding Tester Program. Processing is carried out in accordance with applicable data protection law, in particular the GDPR.
3. Hosting by STRATO
This website is hosted by STRATO. Technically necessary connection and server data are processed when the website is accessed in order to deliver the website, maintain technical stability and detect misuse or attacks. STRATO provides server log files for hosting packages and describes anonymisation of the host name or IP address of the accessing client in the log files provided to customers.
The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest is the secure, stable and efficient provision of this website. Where STRATO processes personal data on our behalf, the requirements of Art. 28 GDPR apply.
4. Contact by email
If you contact us by email, we process the information you provide, including your email address, name, message content and any voluntary additional information, in order to handle your request. Depending on the context, processing is based on Art. 6(1)(b) GDPR or Art. 6(1)(f) GDPR.
5. Founding Tester Program
The current website does not store entries from the Founding Tester form in its own website database. Submitting the form opens a prepared email on the user's device addressed to tester@mxperformance.de. Information voluntarily sent in that email is processed to review the application, make contact and, if selected, organise the test phase.
6. Cookies, analytics and marketing tracking
The current static website does not use our own analytics or marketing tracking services such as Google Analytics or Meta Pixel. If non-essential cookies, analytics tools or comparable access to end-user devices are introduced later, consent will be obtained where legally required and this policy will be updated accordingly.
7. Recipients
Personal data may be disclosed to service providers to the extent technically necessary for hosting and communications. The current website version does not disclose personal data for advertising purposes.
8. Retention
Personal data is retained only for as long as required for the relevant purpose or statutory retention obligations. Email enquiries are deleted when processing is complete unless legal or contractual reasons require continued retention. Founding Tester information is deleted after the selection or test process unless another legal basis or retention obligation justifies longer storage.
9. Your rights
Subject to statutory requirements, you have rights including access, rectification, erasure, restriction of processing, data portability and objection to processing based on Art. 6(1)(f) GDPR. Consent may be withdrawn at any time with effect for the future. You also have the right to lodge a complaint with a competent data protection supervisory authority.
10. Data security
The website is provided via encrypted HTTPS connections. We take appropriate technical and organisational measures to protect personal data against loss, manipulation and unauthorised access.
11. MX Performance apps
This policy applies to the mxperformance.de website. Separate or supplementary privacy information will be provided for MX Setup Pro and other MX Performance apps before publication. Those notices will reflect the services and functions actually used, including local storage, user accounts, cloud synchronisation, backups, photos and documents, push notifications, support data and, where applicable, payment and app-store services.
